Welcome to Kingsway Property Management! Please read these Terms of Service carefully, as they govern your use of our property management services. By signing up for our services, you agree to be bound by these terms.
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “Owner,” or “You”) and Kingsway Property Management (“Kingsway,” “We,” “Us,” or “Our”) located in Charlotte, NC. These Terms govern your access to and use of our property management services, including our website, service portals, and payment processing systems.
Kingsway Property Management provides comprehensive property management services for properties located in and around Charlotte, North Carolina. The specific services provided to you (e.g., tenant placement, rent collection, maintenance coordination) will be detailed in a separate, formal Property Management Agreement executed between you and Kingsway. These Terms are supplementary to, and do not replace, your formal Property Management Agreement.
As a Client, you agree to:
Provide accurate, current, and complete information as required for our services, including during the service sign-up and payment process.
Cooperate fully with Kingsway and promptly respond to our requests for information or authorization.
Ensure that your property complies with all applicable local, state, and federal laws, including North Carolina landlord-tenant laws and fair housing regulations.
All fees for our services are defined in your specific Property Management Agreement.
Payment Processing: We use Stripe as our third-party payment processor for all transactions, including subscription fees and rental income distributions.
Security: By using Stripe for payments, you acknowledge and agree that the processing of payment transactions is subject to the Stripe Terms of Service and Privacy Policy. Kingsway does not store your full payment card details on our servers.
Authorization: By providing payment information, you authorize Kingsway and Stripe to charge the specified amount for services rendered or fees due, in accordance with your Property Management Agreement.
These Terms of Service remain in effect for the duration of your relationship with Kingsway. Termination of the underlying Property Management Agreement will also terminate these Terms. Provisions relating to payment obligations, warranties, liability, and governing law will survive termination.
Our services are provided “as is” and “as available.” To the maximum extent permitted by law, Kingsway Property Management disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
In no event shall Kingsway Property Management, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; or (ii) any unauthorized access, use, or alteration of your information. Our total liability to you for any claim arising out of these Terms or the services shall not exceed the amount paid by you to Kingsway in the three (3) months preceding the event giving rise to the liability.
These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Charlotte, North Carolina.
